3. User Consent for Communications

By providing your phone number and expressly consenting on our website or other opt-in methods, you agree to receive text messages and calls from Amphs AI. Your consent is obtained through clear, affirmative action such as checking a consent checkbox on our forms.

6. User Responsibilities

You agree to use our services only for lawful purposes and in accordance with these Terms. You agree not to use our services in any way that violates any applicable federal, state, local, or international law or regulation; to impersonate or attempt to impersonate Amphs AI, a Amphs AI employee, another user, or any other person or entity; or to engage in any conduct that restricts or inhibits anyone's use or enjoyment of our services.

Our website, services, and all content, features, and functionality are owned by Amphs AI and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

8. Disclaimer of Warranties

We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. To the fullest extent permitted by applicable law, Amphs AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use our services; any conduct or content of any third party on our services; or unauthorized access, use, or alteration of your transmissions or content.

Amphs AI is not liable for any delays, failures in delivery, or any other issues related to the transmission or receipt of text messages. Delivery of text messages is subject to effective transmission by your mobile carrier and is not guaranteed by Amphs AI.

10. Indemnification

You agree to defend, indemnify, and hold harmless Amphs AI and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of our services.

11. Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use our services will immediately cease.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in New York County, New York.
